What a guardianship petition must contain

    The nature, situation and approximate value of any property of the minor, where guardianship of property is sought.

    Whether a guardian has been appointed or claimed by anyone entitled, and any earlier application.

  6. 6.Welfare of the minor

    Why the appointment serves the minor's welfare: age, health, education, the petitioner's ability to care, and the minor's preference if old enough.

  7. 7.Declaration and prayer

    The proposed guardian's declaration of willingness to act, and the prayer to appoint or declare the guardian of the person, the property, or both.

Mistakes that get this document returned

What is the difference between custody and guardianship?

Custody concerns who the child lives with day to day. Guardianship is the legal authority over the child's person or property. A custody petition under Section 25 of the Guardians and Wards Act asks for return of a ward to the guardian's custody.

Is a guardianship certificate needed to sell a minor's property?

For a Hindu minor, the natural guardian needs the court's previous permission under Section 8 of the Hindu Minority and Guardianship Act, 1956 to transfer the minor's immovable property. A court-appointed guardian needs permission under Section 29 of the Guardians and Wards Act.
